MINED LAND RECLAMATION BOARD/STATE OF COLORADO, Public Notice in conformance with the Colorado Sunshine Act of 1972.  The Mined Land Reclamation Board will hold its monthly meeting on Wednesday, September 12, 2007, at 1313 Sherman Street, Room 318, Denver, Colorado, beginning at 9:00 a.m., unless otherwise noticed.

 

Due to the statutory deadlines and other responsibilities and requirements, the following Mined Land Reclamation Board Meeting AGENDA IS TENTATIVE AND WILL BE REVISED.  If you have any questions on specific Agenda Items, please contact the Division at 303.866.3567.

Notice of Determination of Designated Mining Operation Status

Cotter Corporation

 

Re:      Schwartzwalder Mine, Permit No. M-1977-300, Determination of Designated Mining Operation Status

 

Pursuant to the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, Metal and Designated Mining Operations (“Rules” or “Rule”) Rule 7.2.2 (1), the Colorado Division of Reclamation, Mining and Safety (“DRMS” or “Division”) hereby  posts the following Notice of Decision in the Monthly Board Agenda:

 

On August 3, 2007, the Division notified Cotter Corporation (“Cotter”) that the Schwartzwalder Mine is a Designated Mining Operation (“DMO”) pursuant to Rule 1.1 (14).  This finding was based on the fact that the site has the potential to release toxic materials as a result of mining operations.  Specifically, the Division believes that the ore and waste at the Schwartzwalder site are toxic materials, based on the fact that the uranium concentration in the mine pool water is sufficiently elevated such that treatment of the water will be necessary before the water can be released into Ralston Creek.

 

Cotter notified the Division within 30 days that it disputed the DMO finding.  Pursuant to Rule 7.2.4(a), the Office will meet with Cotter to discuss the DMO designation.  If Cotter does not satisfactorily demonstrate to the Division that the operation is not a DMO, the Division shall make a final determination that the operation is a DMO and will notice this determination in a future monthly Board agenda.  If the Division does make a final determination that the Schwartzwalder Mine is a DMO, Cotter will then have 30 days after such determination to appeal the decision pursuant to Rule 7.2.4(b).
